Chapter 1: Introduction
In accordance with the requirements by the Delegated Regulations (DR) (EU) No 885/2013 (SSTP), No 886/2013 (SRTI), No 2015/962 and the updated version No 2022/670 (RTTI), No 2017/1926 (MMTIS) supplementing the ITS Directive (2010/40/EU), Member States (MS) should designate a national body or competent authority to assess whether the requirements set in the particular DR are fulfilled by the respective designated stakeholders. Terms National Body and Competent Authority are used in the delegated acts to refer to an entity performing similar tasks. For this reason, the term "National Body" is used to refer to both "national body" and "competent authority" used in the delegated acts. The main tasks of the National Bodies include receiving self-declarations, performing randomly selected compliance assessments, and reporting to the MS.
The National Body Reference Architecture is relevant for the harmonisation of the functionalities and procedures of the designated bodies which are in charge of the compliance assessment. The architecture is a concept and methodology based on the European ITS Framework Architecture (hereafter - FRAME Architecture). The main objective of this work was to create an architecture for the harmonisation of National Bodies activities on the European level as well as increasing their effectiveness. From the perspective of the National Body, the architecture defines its roles, functions, and processes. From a governance and compliance assessment point of view, it defines the minimum requirements to be met at the national level in aim to achieve the harmonisation of National Bodies activities as well as their interoperability at European level. An architecture should be seen as a functional framework providing mechanisms that can be customised by the national bodies according to their individual requirements. The National Body Reference Architecture aims to support the National Bodies
- by providing guidance to set up national body by taking into account the requirements at national level and requirements for harmonisation at European level
- by establishing trustworthy relationships between Data/Service providers, NAP operators and national bodies
- by facilitating the engagement with Data/Service providers for submitting self-declarations to the NAP
- by establishing a governance structure that does not require a centralised approach
